Tomato Energy Ltd: Decision to confirm Provisional Order 

On 09 July 2025, following a consultation period, the Authority issued the confirmed Provisional Order, with modifications, to Tomato Energy Ltd (“Tomato Energy”).  The Provisional Order was first issued to Tomato Energy on 10 April 2025. 

This confirmed Provisional Order requires that Tomato Energy: 

  1. Obtain and maintain Liquidity of a sufficient amount and Quality by 4pm on 31 August 2025. 
  2. Put in place and maintain robust internal capability, systems and processes to enable the licensee to comply with relevant legislative and regulatory obligations. 
  3. Until compliance with SLC 4A and SLC 4B.1 is achieved, be subject to a: 
  4. “Sales Ban” 
  5. “Non-Essential Payments Ban” 
  6. Notify the Authority in writing, within the prescribed time frames, when it becomes aware that there is a Material risk that any Trigger Points may occur or where Trigger Points have occurred. 

The Authority issued a notice of proposal to confirm the Provisional Order on 13 June 2025. The notice of proposal invited representations or objections in relation to the proposed confirmation to be made to the Authority by 7 July 2025. The Authority received one representation in response to the proposal to confirm the Provisional Order, which the Authority duly considered. The Authority is satisfied that Tomato Energy is contravening, or is likely to contravene SLC 4A.1, SLC 4B.1 and SLC 4B.8 and that no further modifications were required to the provisional order.
