Investigation into Maxen Power Supply Limited and its compliance with the gas and electricity supplier standard licence conditions.

We have issued a notice of proposal to impose a financial penalty to Maxen Power Supply Limited (Maxen Power).

This notice has been issued because we consider that Maxen Power has not complied with the rules in the standard licence conditions relating to energy theft of the gas and electricity supply licences.

We are proposing a financial penalty requiring Maxen Power to pay £1,250,000. This follows the provisional order that lapsed and ceased to have effect on 12 December 2025. Read details about a related Provisional Order issued to Maxen Power.

Enforcement description

Maxen Power is a UK-based non-domestic utilities supplier based in east London.

We launched an investigation into Maxen Power and have been considering the supplier’s compliance with rules around treating microbusinesses fairly (standard licence condition 0A) and matters relating to energy theft (standard licence condition 12.A and 12A).

We have since expanded our investigation and are also assessing the supplier’s compliance with rules around the:

  • maintenance of robust internal capability, systems and processes (standard licence condition 4A)
  • requirement to ensure it has fit and proper persons in positions of Significant Managerial Responsibility and Influence (standard licence condition 4C (1, 2 and 3)
  • principle to be open and cooperative with us (standard licence condition 5A)

We have issued a notice of proposal to impose a financial penalty on Maxen Power. The notice has been issued as we consider that Maxen has failed to comply with licence conditions referred to in the provisional order published in September 2025.

This proposed penalty relates to standard licence conditions 12A.12(g) and 12A.13, of the gas supply licence, and 12.A.11(h) and 12.A.12, of the electricity supply licence only.

These conditions require the licensee to communicate appropriately with customers on matters relating to energy theft and maintain a record of its compliance.

The investigation will remain ongoing and continue to examine whether Maxen Power is in compliance with the requirements of the other standard licence conditions.

Continuing this investigation does not imply that we have made any findings regarding compliance with the other relevant standard licence conditions.

Representations or objections regarding the notice of proposal to impose a penalty must be submitted to the us by 8 April 2026.
