NOTICE OF REVOCATION OF A LICENCE PURSUANT TO SECTION 6 OF THE ELECTRICITY ACT 1989
Notice of Revocation
Whereas
1. URE Energy Limited, (company registration number 10300613), having its registered office at 2-4 Packhorse Road, Gerrards Cross, Buckinghamshire, SL9 7QE, is the holder of an Electricity Supply Licence (the “Licence”) granted or treated as granted under Section 6(1)(d) of the Electricity Act 1989 (the “Act”).
2. Section 6(8) of the Act provides that a licence granted or treated as granted under the Act may be revoked in accordance with any term contained in it.
3. Paragraph 1(c)(i) of Schedule 2 of the Licence provides that the Gas and Electricity Markets Authority (the “Authority”) may at any time revoke the Licence on giving no less than 30 days’ notice to URE Energy Limited where it fails to comply with a final order which has been confirmed under that section and such failure is not rectified to the satisfaction of the Authority within three months after the Authority has given notice in writing of such failure to the licensee.
4. The Authority gave the licensee a notice on 1 May requiring rectification of its failure to comply with the final order and three months has now elapsed since the date of such notice.
5. The licensee has not rectified the failure to comply with the confirmed final order imposed against it by the Authority on 8 March 2019.
6. This final order required payment by the licensee to Ofgem by 31 March 2019 of £209,013.78 being monies owed in relation to the licensee’s Renewables Obligation for the year 2017-2018.
Reasons for Decision
7. The Authority has decided that the Licence should be revoked in accordance with paragraph 1(c)(i) of Schedule 2 of the Licence because the Licensee has failed to comply with the final order 8th March 2019, namely a failure to pay to the Authority the sum of £209,013.78.
Therefore
8. The Authority hereby gives notice that, unless the Authority otherwise directs, the Licence will be revoked with effect from 14 September 2019.
