Decision on the temporary facilitative licence condition to support the implementation of the Independent System Operator and Planner.

On 12 April 2024, we published a consultation proposal to add a temporary facilitative condition to all standard licence conditions, as well as to the Smart Meter Communication licence, in order to prepare for any potential scenario of cooperation and facilitation that may be required to support implementation of the Independent System Operator and Planner (ISOP), also now known as the National Energy System Operator (NESO). These proposed modifications would (if made) oblige the licensees to cooperate in, and to not frustrate, the transition to the ISOP if required. As well as require that the licensees must take any reasonable steps to enable the ISOP Implementation Objectives are met and give full effect to any ISOP Change Programme (as defined in the new condition). 

Following consideration of the consultation responses, we have decided not to modify all standard licence conditions as well as the Smart Meter Communication Licence to include a temporary facilitative licence condition. The reasons for this are set out in our decision notice. We have published all non-confidential responses on our website.
