Determination pursuant to regulation 3(8) of the code manager selection regulations 2024 of the basis of selection of code managers for the consolidated Electricity Commercial Code and Gas Network Code.
Under new powers created by the Energy Act 2023, we will be responsible for selecting code managers on either a competitive or non-competitive basis, leading to the potential grant of a code manager licence. Each code manager will be responsible for the governance of its respective code, which they will be obligated to do in an independent and impartial manner. They will also be responsible for facilitating the development of the codes in line with the policy priorities set out in our annual Strategic Direction Statement.
We sought expressions of interest from any person interested in becoming a code manager candidate for the consolidated Electricity Commercial Code or Gas Network Code in January 2026. This determination sets out the decision of the Authority, under section 187(1) of the Energy Act 2023, to proceed with the selection of code managers for both of these codes on a non-competitive basis.
Following this determination, both Xoserve Ltd and the Retail Energy Code Company Ltd will be invited to submit licensing assessment forms for the relevant code. We will then consider this information and publish a notice stating whether we propose to grant them a code manager licence.
