On 11 November 2022, we published a statutory consultation (the Consultation) under section 11A(2) of the Electricity Act 1989 on proposed modifications to Offshore Electricity Transmission Licences. Those proposed modifications fell into three main groupings:
- modifications for licences to amended standard condition E12-A1;
- modifications for licences to amended standard condition E12-J3; and
- modifications for licences to amended standard condition E12-J4 (Part A and Part C).
We asked for any representations to the modifications to be made on or before 9 December 2022.
On 28 June 2023, the Authority published its decision to proceed with modifications proposed in the Consultation to amended standard condition E12-A1 (concerning the end of the transition period following the United Kingdom’s exit from the European Union) and Part C of amended standard condition E12-J4 (concerning incremental capacity arrangements).
Having considered the responses, the Authority has now decided to proceed with the remaining modifications proposed in the Consultation to amended standard condition E12-J3 (concerning health reviews/investment works/decommissioning costs) and Part A of amended standard condition E12-J4 (concerning availability lost during health reviews and investment works).
The Authority hopes to respond to the separate June 2022 consultation on End of Tender Revenue Stream issues by autumn 2023.
