Modifying the standard conditions of the electricity interconnector licence

On 23 April 2026, we published a statutory consultation (the consultation) under section 11A(2) of the Electricity Act 1989 on proposed modifications to Electricity Interconnector Licence. The modifications fell into two main groupings:

• modifications to Standard Licence Condition 26A: Delay to Regime Start Date caused by Pre-operational Force Majeure
• modifications to Standard Licence Condition 26B: Delay to Regime Start Date caused by Pre-operational Force Majeure (Third Window)

We asked for representations to the modifications to be made on or before 21 May 2026. In accordance with section 11A of the Electricity Act 1989, notice of the modifications was provided to the Secretary of State, Citizens Advice and Consumer Scotland.

We received seven responses to the consultation. Having considered the responses, the Authority has decided to proceed with the modifications.

Consultation description

We are consulting on proposed modifications to the electricity interconnector licence.

The amendments fall into two main groupings, which are:

• proposed modifications to Standard Licence Condition 26A: Delay to Regime Start Date caused by Pre-operational Force Majeure
• proposed modifications to Standard Licence Condition 26B: Delay to Regime Start Date caused by Pre-operational Force Majeure (Third Window)

This consultation seeks to amend the definition of Pre-Operational Force Majeure definition as defined in Standard Licence Condition 26A. We are also consulting on amending the definition of Backstop date as defined in Standard Licence Condition 26B.
