In November 2021, we consulted on proposals to modify the licence to allow us to make an in-period adjustment to the cap level in exceptional circumstances. Having reviewed stakeholder responses to this consultation, we have decided to proceed with the modification.
We have decided to implement a test framework that consists of a set of five qualitative criteria which will be guided by quantitative data. We expect an exceptional circumstance to meet our test framework to trigger an in-period adjustment.
