Consultation on Ofgem's Statement of Policy in respect of Financial Penalties and Consumer Redress

We have been reviewing our approach to enforcement. As part of implementing the conclusions of the review, we consulted on changes to our Penalties policy. We received 17 responses, which we have published below.

We have considered the responses and have now published our revised statement of policy on financial penalties and consumer redress under the Gas Act and Electricity Act.  The new policy statement emphasises the central role of penalties and redress in securing fair outcomes for consumers and deterring non-compliance. It also explains how we will use our new powers under the Energy Act 2013 to require companies to provide redress to consumers, compensating them directly where possible.

We have also published a decision document setting out how we have taken into account the responses that we received to the consultation. This work complements our recently published enforcement guidelines and our open letter setting out the Authority’s position on future financial penalties.
