This document contains Ofgem’s response to the Claims management regulation: consultation on secondary regulations issued by HM Treasury. We outline our views that, in order to better protect consumers, businesses pursuing wall insulation claims should be included under the remit of the claims management regulator.
Over the past eight months we have seen a steady increase in Subject Access Requests (SARs) from these types of businesses. To ensure our administrative process is robust and protects personal data, in March 2018 we amended our administrative process for responding to SARs. Further details of this can be found here. In order to suitably protect consumers Ofgem believes that these businesses should be regulated to put them on a level playing field with other regulated bodies. As things currently stand these businesses remain unregulated for this spectrum of work. Where we suspect fraudulent activity from any party, we will continue to make referrals to Action Fraud.
