Freedom of Information

Ofgem is bound by Freedom of Information and Environmental Information legislation (see our Freedom of Information page for more information) and as such can be asked to disclose any information that we hold. We will always work closely with you if we are asked to share any information that relates to your organisation or your project and will apply relevant exemptions from disclosure where appropriate.

To help us in this process, when submitting information to us, please let us know if you consider any of that information to be sensitive and/or commercially confidential (and mark it appropriately) and the reasons why your organisation considers it to be sensitive and/or commercially confidential.

When giving such reasons:

  • Please explain whether and why your organisation considers such information to be unique and/or novel
  • Describe any potential harm you think your organisation may be subject to if that information was disclosed to third parties and/or the public by us.

Further information on sharing commercially sensitive information

Without your express written consent, or unless we are required to so by law, statutory directions, court orders, or government regulations, we will not share information that your organisation has shared with us. Your organisation must clearly identify to us, in writing, that the information is commercially confidential and provide cogent reasons why your organisation regards such information to be commercially confidential.
