In December 2018, we introduced a new condition (31D and 43B) in the electricity distribution licence to ensure distribution network operators cannot operate generating stations, including storage. We have also published the Prohibition on Generating Guidance (POGG) alongside the new condition.

In December 2020, licence conditions 31D and 43B were modified to transpose Article 36 of the EU Directive 2019/944 (commonly known as the Clean Energy for all Europeans Package (CEP)) into GB regulations. This article set out that DNOs must not “own, develop, manage, or operate energy storage facilities”. It also sets out new reporting requirements for licensees who operate generation and/or storage under an exception granted by the Authority.

We are seeking your feedback on the proposed updates to the POGG to include further guidance on the new reporting requirements for licensees set out within SLC 31D.3 and 43B.3.
