On 19 June 2015 we published our Decision on the Statutory consultation on amendments to the Capacity Market Rules. Our decision regarding change proposal, CP73, clarified that when the Delivery Body receives both an opt-out notification and a prequalification application in respect of the same CMU for the same auction, the latest to be submitted should apply.
However, our changes also have the inadvertent effect of excluding parties who voluntarily opted out of the T-4 auction but who intend to remain operational in the Delivery Year from participating in the corresponding T-1 auction. This was not our intention and the attached letter explains that we intend to change to the Rules accordingly before the first T-1 prequalification round in 2017.
