We are publishing our determinations in respect of Tier 2 Capacity Market Disputes we received during the Prequalification process for the 2019/20 T-1 and 2022/23 T-4 auctions.
NGET, as the delivery body for EMR, is responsible for assessing prequalification applications for the Capacity Market and issuing its decisions.
If an applicant disagrees with NGET’s decision, it may ask NGET to review it – a Tier 1 dispute. Following a Tier 1 review, the appellant can ask us to consider NGET’s decision and make a determination – a Tier 2 dispute.
Our review is of whether NGET had applied the CM Regulations and CM Rules correctly when making its decision, based on the evidence before it when it did so.
