This proposal would amend the Rules so that, where a Demand-Side Response (DSR) CMU has failed to demonstrate satisfactory performance up to the volume of the Capacity Obligation but has demonstrated at least 90% of the required volume, a CMU may choose to reduce its Capacity Payments proportionally rather than continue to attempt to demonstrate satisfactory performance. It is proposed that where this option to reduce Capacity Payments is taken, the relevant CMU is subject to an additional penalty equal to TF1 multiplied by the under-delivery volume.
