We received a submission from NGET on 26 July 2021, and from NGESO on 24 August 2021, requesting to be relieved of their obligations to comply with the SO-TO Code for the connection application process associated with the Phase 3 Stability Pathfinder tender. This letter outlines our decision to provide a direction (under our powers outlined in standard licence condition B12(15)) that they do not need to comply with Section D Part 2 of the SO-TO Code for the purposes of the Stability Phase 3 Pathfinder tender process, instead following the agreed process laid out in this letter on a trial basis. We expect NGESO and NGET to now work with other SO-TO Code parties to update the SO-TO Code with an enduring solution to this issue.
