Enforcing Consumer Protection Law 

 

Ofgem monitors companies to ensure that they comply with European and UK consumer protection law.

 

Under the Enterprise Act 2002, the Authority has powers to investigate traders’ compliance with various consumer protection laws.  Where the Authority considers a breach has occurred, it can apply to court for an enforcement order requiring a trader to comply.  The Authority can also accept undertakings from the trader that the trader will not continue or repeat the conduct. Legislation covered by the Act includes:

 

  • The Consumer Protection from Unfair Trading Regulations 2008
  • The Consumer Protection (Distance Selling) Regulations 2000
  • The Unfair Terms in Consumer Contracts Regulations 1999
