Notice under section 7A(9) of the Electricity Act 1989 (as amended) of the proposed transfer of an Electricity Generation licence held by Energiekontor UK PI Ltd to Energyfarm UK Pines Burn LLP.

The Gas and Electricity Markets Authority (‘the Authority’) hereby gives notice pursuant to Section 7A(9) of the Electricity Act 1989 (as amended) (‘the Act’) as follows:

1.  Energiekontor UK PI Ltd, (company registration number SC624998), the registered office of which is 11, 2nd Floor Somerset Place, Glasgow, G3 7JT, United Kingdom, has written to the Authority seeking its consent under Section 7A of the Act to the transfer of the Electricity Generation licence granted to Energiekontor UK PI Ltd, pursuant to section 6(1)(a) of the Act to Energyfarm UK Pines Burn LLP (company registration number OC428008), the registered office of which is at 4330 Park Approach, Thorpe Park, Leeds, United Kingdom, LS15 8GB.

2.  The Authority proposes to grant consent to the proposed licence transfer which, subject to our consent, is currently proposed to take place on 19 May 2020, for the following reasons:

(i)  Energiekontor UK PI Ltd has applied to the Authority under Section 7A of the Act for the Authority’s consent to the transfer of the Electricity Generation licence to Energyfarm UK Pines Burn LLP; and

(ii)  The Authority is satisfied that it would have been appropriate to grant an Electricity Generation licence to Energyfarm UK Pines Burn LLP had Energyfarm UK Pines Burn LLP applied to the Authority for such a licence and as such considers that it is appropriate to consent to a transfer of an existing Electricity Generation licence to Energyfarm UK Pines Burn LLP.

3.  Any representations or objections in relation to the proposal by the Authority to grant consent to the proposed licence transfer should be made in writing no later than 9 May 2020 to the Authority, either:
