Decision to derogate IUK from certain articles of the EU Network Code on Tariffs

Commission Regulation (EU) 2017/460 establishing a network code on harmonised transmission tariff structures for gas (TAR) allows merchant interconnectors to seek derogation for articles that could jeopardise their efficient operation.
On the 5 December 2017, Interconnector UK (IUK) submitted an application for derogation pursuant to Article 37 of TAR.
This letter outlines our decision granting IUK derogation from certain articles of TAR and our reasons for doing so in line with the criteria in Article 37. We have assessed IUK’s request for derogation in close cooperation with the Commission for Electricity and Gas Regulation (CREG), the Belgian National Regulatory Authority.
