Approval of the updated Access Rules for the Nemo Link interconnector to apply in case the UK leaves the EU without a deal

Nemo Link Limited (“NLL”) submitted updated Access Rules for the Nemo Link interconnector to the Authority on 14 August 2019. The Access Rules set out the terms and conditions for access to, and including use of, the interconnector.

These updated Access Rules look to further build upon the modified Nemo Link Access Rules to apply in the event that the UK leaves the EU without a deal, approved on 15 March 2019.  

These updated Access Rules would enter into force on 14 November 2019 in the event the UK leaves the EU without a deal. For the avoidance of doubt, if the UK leaves the EU without a deal on the 31 October 2019 the modified Nemo link Access Rules, approved on 15 March 2019, will apply until the modified Access Rules come into effect on the 14 November 2019.

We have decided to approve the updated Access Rules proposed by NLL on the basis that they achieve the relevant access rules objectives. This letter contain a direction approving the updated Access Rules. A joint opinion between Ofgem and the Belgian National Regulatory Authority, the Commission de Régulation de l'Electricite et du Gaz, on the modified Access Rules is included as a separate attachment.
