Approval of the updated Access Rules for the Britned interconnector to apply in case the UK leaves the EU without a deal

Britned Development Limited (“Britned”) submitted updated Access Rules for the Britned interconnector to the Authority on 15 October 2019. The Access Rules set out the terms and conditions for access to, and including use of, the interconnector.

These updated Access Rules look to further build upon the modified Britned Access Rules to apply in the event that the UK leaves the EU without a deal, approved on 15 March 2019.  

These updated Access Rules would enter into force in the event the UK leaves the EU without a deal on the 31 October 2019. For the avoidance of doubt, the updated Access Rules will supercede and render redundant the modified Britned Access Rules approved on 15 March 2019.

We have decided to approve the updated Access Rules proposed by Britned on the basis that they achieve the relevant Access Rules objectives. This letter contains Directions approving the updated Access Rules. A joint opinion between Ofgem and the Dutch National Regulatory Authority, the Authority for Consumers & Markets, on the updated Access Rules is included as a separate attachment.
